FAVunite TV respects intellectual property rights and expects Contributors and users to do the same. This Policy describes our DMCA notice-and-takedown procedures and repeat infringer policy. It is incorporated by reference into the Content Contributor Agreement (CCA).
1. Designated Agent (In Progress)
FAVunite TV is in the process of finalizing its Designated Agent registration. Until registration details are posted here, rights holders may submit notices via the contact method provided on this page. Once finalized, the Designated Agent’s name, address, telephone number, and email will be published here.
2. Submitting a DMCA Notice
To request removal of allegedly infringing material under 17 U.S.C. §512(c)(3), please provide a written notice that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., URL); (d) your contact information; (e) a statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner.
3. Counter-Notice
If you believe your content was removed or disabled by mistake or misidentification, you may send a counter-notice under 17 U.S.C. §512(g)(3) that includes: (a) your physical or electronic signature; (b) identification of the material removed and the location where it appeared; (c) a statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification; (d) your name, address, and telephone number; and (e) a statement that you consent to the jurisdiction of the Federal District Court for your address (or Johnson County, Kansas, if your address is outside the U.S.) and that you will accept service of process from the person who provided the original notice or an agent of such person.
4. Repeat Infringer Policy
In appropriate circumstances, FAVunite TV will terminate accounts of users or Contributors who are determined to be repeat infringers. We also reserve the right to limit access to the service and/or terminate accounts for any users who infringe intellectual property rights, whether or not repeat infringement is involved.
5. Good-Faith Removal and Geoblocking
Upon receipt of a facially valid notice or other credible claim (including content ID/fingerprinting matches), we may remove, disable, geoblock, or otherwise limit the content and notify the Contributor where practicable. We may also place reserves/holds on payouts related to disputed content, consistent with applicable law and processor rules.
